Election Tribunal dismisses 3 petitions against Bayelsa Governor

The Bayelsa State Governorship Election Tribunal sitting in Abuja has dismissed 3 petitions against the victory of Senator Douye Diri of the Peoples Democratic Party, PDP as Governor.

The first petition to be dismissed was that filed by the candidate of Alliance for Democracy, Owei Moniwei. The Tribunal held that it was incompetent and amounted to an academic exercise.

In the judgement delivered by Justice Owodunni, the Tribunal held that the Deputy Governor is eminently qualified having fulfilled the provision of Section 177 of 1999 Constitution and the alleged error on certificate was corrected by the NYSC and the evidence corroborated by an NYSC Director who testified under oath.
The petitioner was said to have failed in proving his case which was dismissed and the sum of N200,000 awarded in favour of all the 3 respondents except INEC.

In its judgement in the second petition filed by the United Peoples Congress and its candidate, Ibiene Stephen which also challenged the eligibility of the Deputy Governor, Justice Yinusa Musa said the matter was status barred and that the Tribunal lacked jurisdiction to entertain pre-election issues.

The sum of N200,000 was also awarded in favour of the respondents.
